1. About Elvexa

Elvexa provides dynamic portfolio hosting, campaign briefing workspace, directory filters, and direct messenger interfaces. All monetary settlements and payments are done privately outside of our platform.

2. Acceptance of Terms

By accessing or using Elvexa in any capacity, you confirm that you have read, understood, and agreed to these Terms & Conditions in full. If you do not agree, do not use the Platform. These terms apply to all users including creators, brands, agencies, and visitors. Users under the age of 18 are strictly prohibited from using this platform.

3. Eligibility & Age Restriction

You must be at least 18 years of age to create an account or use any feature of Elvexa. By registering, you confirm that you are 18 years of age or older, have the legal capacity to enter into a binding agreement, and are not barred from using the Platform under any applicable law. We reserve the right to terminate any account found to belong to a user under the age of 18 without prior notice.

4. Creator Accounts

As a creator on Elvexa you agree to:

• Provide honest and accurate information about your audience, follower counts, engagement rates, and platforms.
• Only list yourself in niches and categories that genuinely represent your content.
• Keep your availability status, rate card, and profile information current and accurate.
• Respond to brand collab requests professionally and in a timely manner.
• Not misrepresent your identity, credentials, or past brand partnerships.
• Not inflate or artificially boost follower counts, engagement, or any reported metrics.
• Not use bots, click farms, or any automated tools to manipulate platform metrics.
• Comply with all applicable laws including ASCI disclosure guidelines for sponsored content.

Important: Elvexa does not verify follower counts, engagement rates, or any self-reported creator statistics. Brands rely on creator-provided data entirely at their own discretion. Elvexa accepts no liability for inaccurate creator metrics.

5. Brand Accounts

As a brand on Elvexa you agree to:

• Provide accurate company information and represent a legitimate registered business or individual.
• Only post genuine, lawful campaign opportunities with realistic budgets and achievable deliverables.
• Not use creator contact information for any purpose outside of legitimate collaboration arranged on this platform.
• Not harvest, scrape, or bulk-export creator data.
• Treat all creators with professionalism and respect.
• Honor all commitments and agreed terms made to creators.
• Ensure all campaigns comply with applicable Indian laws and ASCI advertising guidelines.
• Not post campaigns for prohibited product categories as defined in Section 9 of these Terms.

6. Zero-Commission Storefronts

Creators may activate a storefront on their Elvexa profile to sell physical merchandise, digital downloads, or creative services. Elvexa takes zero commission on storefront sales.

All storefront transactions are conducted directly between the creator and their customer. Elvexa is not a party to any storefront transaction and accepts no liability for product quality, delivery, refunds, disputes, or any other matter arising from storefront sales.

Creators are solely responsible for ensuring their storefront products and services comply with applicable laws including consumer protection laws, GST obligations, and any relevant product safety regulations.

7. ASCI Disclosure Compliance

All paid brand collaborations arranged through Elvexa must comply with the Advertising Standards Council of India (ASCI) guidelines on influencer advertising. Specifically:

• All sponsored content must be clearly disclosed using #ad, #sponsored, #collab, or #partnership.
• Disclosures must be prominent, upfront, and not buried in a list of hashtags.
• Video content must include a verbal or on-screen disclosure at the beginning.

Both the brand and the creator are independently responsible for ASCI compliance. Elvexa will display a compliance reminder at the point of campaign activation but ultimate responsibility lies with the parties involved.

8. TDS Obligations

Elvexa does not process payments between brands and creators. However, brands should be aware of their tax obligations under Indian law:

• Payments to creators exceeding ₹30,000 per year may attract TDS deduction obligations under Section 194C or Section 194J of the Income Tax Act 1961.
• Brands are solely responsible for determining and fulfilling their TDS obligations.
• Elvexa is not a tax advisor and does not provide tax guidance.

We strongly recommend brands consult a qualified chartered accountant regarding their TDS obligations on influencer payments.

9. Prohibited Campaigns & Content

The following campaign types and content categories are strictly prohibited on Elvexa:

Violations will result in immediate campaign removal and account suspension. Repeated violations will result in permanent bans. We reserve the right to determine what constitutes a violation at our sole discretion.

10. Payments & Subscriptions

Elvexa subscription plans for brands:

• Free Plan — ₹0/month: Browse only, no creator contact
• Starter Plan — ₹299/month: 3 campaigns, 10 creator contacts
• Growth Plan — ₹799/month: Unlimited campaigns, 50 creator contacts, advanced features
• Pro Plan — ₹1,499/month: Unlimited everything, premium features
• One-Time Deal Access — ₹149 flat: Single campaign, no subscription

Creator Pro subscription is available for ₹99/month for enhanced visibility and analytics.

All subscription fees are in Indian Rupees (INR). Plans auto-renew unless cancelled before the renewal date. Subscription fees are non-refundable once a billing period has commenced. We reserve the right to modify pricing with 30 days prior notice to subscribers.

11. Intellectual Property

All platform content including but not limited to the Elvexa name, logo, design, code, and original text is owned by Raiyan Kamal / Elvexa and protected under applicable intellectual property laws.

By uploading content to your profile, you grant Elvexa a non-exclusive, royalty-free, worldwide licence to display that content on the platform for the purpose of operating the service. You retain full ownership of all content you upload. We will not sell or licence your content to third parties. The Elvexa trademark is the property of Raiyan Kamal. Unauthorised use of the Elvexa name, logo, or branding is prohibited.

12. Disclaimer of Liability

Elvexa is a connection and discovery platform only. We are not a party to any agreement, contract, or transaction between a brand and a creator. We are not responsible for:

• The quality, accuracy, or completeness of any creator's content or deliverables.
• A brand's failure to pay a creator for completed work.
• A creator's failure to deliver agreed content to a brand.
• Any disputes, losses, or damages arising between brands and creators.
• The accuracy of self-reported creator metrics including follower counts and engagement rates.
• Any outcomes resulting from campaigns arranged through the platform.
• Any storefront transactions between creators and their customers.

Use of Elvexa is entirely at your own risk. The platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

13. Account Suspension & Termination

We reserve the right to suspend or permanently terminate any account at our sole discretion if the account holder violates any provision of these Terms & Conditions, posts prohibited campaigns or content, provides false or misleading information, engages in fraudulent or harmful behaviour, attempts to circumvent platform systems, or is found to be under 18 years of age.

You may delete your account at any time. Upon deletion, your public profile will be removed within 48 hours. We may retain certain data as required by law.

14. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of India. Any disputes arising from or relating to use of Elvexa shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in India.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to registered users via email or in-app notification at least 14 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.

16. Contact
